The Federal High Court sitting in Abuja, has on Thursday ruled on the bail application filed by Abba Kyari, the suspended Deputy Commissioner of Police.
The presiding judge, Justice Inyang Ekwo, in a ruling on Thursday, ordered the National Drug Law Enforcement Agency (NDLEA) to respond to the request filed by the embattled police officer within 48 hours.
Earlier, counsel to the anti-narcotic agency,
Mike Kasa, had informed the court that he had not been served with Abba Kyari’s bail request attached to his suit marked FHC/ABJ/CS/182/22.
In a short judgement, the judge asked the parties to sort out themselves and appear before him on February 28 for the continuation of the case.
Recall that the embattled former commander of the Intelligence Response Team, IRT, had dragged the Federal government to court over his continued detention in the NDLEA custody.
Kyari had through his lawyer, Cynthia Obianuju Ikena, asked the court to order his release or alternatively set liberal bail conditions for him.
The police officer claimed to be suffering from chronic diabetes threatening his life and therefore needs urgent medical attention.
He also asked the court to order the government to pay him N500million and also tender written apology to him in two national dailies for the unlawful violation of his fundamental human rights.
But his request seeking release from the NDLEA custody was rejected after the court asked him to notify the government of the existence of the suit he instituted against it.
